By accessing or using Magpie, you agree to these terms. Please read them carefully.

Agreement to Terms

By accessing or using Magpie (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Who Operates Magpie

Magpie is operated by an independent developer ("Magpie," "I," "me"). Location: New Jersey, USA. For questions or concerns, please use the Contact form.

Eligibility & Accounts

Age Requirement

You must be at least 13 years old to use Magpie.

Account Creation

You may create an account using email (magic link), GitHub OAuth, or other supported authentication providers. Different sign-in methods may enable different features.

Account Security

You are responsible for maintaining the security of your account and any credentials used to access the Service. You are responsible for all activity that occurs under your account and must notify me promptly of any unauthorized use.

Accurate Information

You agree to provide and maintain accurate account information.

GitHub Integration

Magpie optionally connects to GitHub to back up your notes to a repository you choose. This connection is not required to use the Service.

If you connect GitHub, Magpie receives permission to access the repositories you explicitly choose via a GitHub App installation. Magpie may create commits in your repositories only in response to actions you take (such as saving or updating content). All commits are authored as the authenticated GitHub user.

You may revoke Magpie's GitHub access at any time through your GitHub account settings. Revoking access does not affect content already stored in your repositories or in the Service.

Substack Integration

Magpie offers an optional Substack sync feature that imports your Substack activity (such as articles, comments, and engagement data) into Magpie for personal reference and organization.

How It Works

To enable Substack sync, you provide a Substack session cookie. This cookie is encrypted before storage and is used solely to authenticate requests to Substack on your behalf. Magpie accesses Substack through its available interfaces, which may change without notice.

What Is Synced

Magpie may sync articles you have published or saved, comments and replies, and engagement activity from your Substack account. Synced content is stored in the Service for your personal use.

Limitations

Substack sync relies on unofficial Substack interfaces. Substack may change or restrict access at any time, which could affect the availability of this feature. Magpie does not guarantee uninterrupted sync functionality.

Disconnecting

You may disconnect Substack at any time from your account settings. Disconnecting removes the stored cookie. Previously synced content remains in the Service unless you delete it.

Browser Extension

Magpie offers an optional browser extension (Chrome and compatible browsers) that allows you to save content directly from your browser. The extension authenticates through the same account you use for the Service and sends saved content to Magpie for processing and storage.

iOS App & Share Extension

Magpie offers an iOS app with features including typed notes, voice notes, and a share extension. The share extension allows you to send URLs and text from other apps to Magpie for processing and storage.

Voice Notes

The iOS app can record audio using your device microphone and send it to the Service for transcription and storage. Audio recordings are transmitted over encrypted connections. Transcription is performed by a third-party AI provider (see AI Transparency and Privacy Policy for details).

In-App Purchases

The iOS app offers subscription purchases through Apple's App Store. These purchases are governed by Apple's terms in addition to these Terms. See the Pricing section for details.

MCP (AI Client Access)

Magpie provides a Model Context Protocol (MCP) server that allows compatible third-party AI clients (such as Claude Desktop) to access your Magpie data on your behalf.

What MCP Clients Can Access

When you connect an MCP client, it can read, search, create, and modify your bookmarks, folders, and user context — the same data you can access through Magpie directly.

Authorization

MCP access requires explicit authorization through an OAuth flow. You can revoke a client's access at any time.

Your Responsibility

When you connect a third-party AI client via MCP, your data is transmitted to that client and processed according to that client's own terms and privacy practices. Magpie is not responsible for how third-party clients handle your data after it leaves the Service.

Content & Ownership

Your Content

You retain all ownership rights to your notes, ideas, and other content you create or manage using Magpie. If you connect GitHub, your content may also be backed up to repositories you own and control.

Where Content Lives

Content is stored in Magpie's infrastructure (hosted on Supabase). If you connect GitHub, content is also synced to your GitHub repository as a backup. You can access and export your content at any time through the Service or, if connected, directly through GitHub.

Limited License to Operate

You grant Magpie a limited, non-exclusive, revocable license to access, read, write, and process your content solely to provide the Service at your direction. This includes processing by AI systems to provide features such as organization, search, and transcription. This license ends when you delete your account, subject to the limited technical retention described in the Privacy Policy.

AI Processing

Your content is processed by AI-powered tools to provide features such as titling, tagging, summarization, search, transcription, and organization. See the AI Transparency page for full details. Your content is not used to train AI models.

SMS Notes

Magpie offers an optional SMS feature that lets you text notes to a Magpie phone number. To use this feature, you must link your phone number in your account settings and explicitly consent to receive SMS confirmation messages from Magpie.

Consent & Opt-Out

By linking your phone number, you agree to receive SMS confirmation messages from Magpie. Message frequency: 1 message per note submitted. Message and data rates may apply. Reply STOP to any Magpie message to opt out at any time. To re-enable the feature, visit your account settings to re-consent. Reply HELP for support.

Rate Limits

To prevent abuse, Magpie limits the number of SMS messages you can send per hour. Messages that exceed these limits will be rejected temporarily. Repeated misuse may result in SMS access being suspended.

Acceptable Use via SMS

SMS notes are subject to the same Acceptable Use rules as the rest of the Service. You may not use the SMS feature to send spam, test automation, or content that violates applicable law or these Terms.

Acceptable Use

You agree not to: Violate applicable laws or third-party rights. Upload malicious code or attempt to disrupt the Service. Access or probe systems without authorization. Use the Service for harassment, abuse, or other harmful activity.

Service Availability & Changes

The Service is provided "as is" and "as available." I do not guarantee uninterrupted or error-free operation.

I may modify, suspend, or discontinue parts of the Service at any time for maintenance, security, or operational reasons.

Data Backup & Portability

You are responsible for maintaining your own backups of important content.

If you connect GitHub, your notes are synced to a repository you control and can be accessed independently of the Service. If you do not connect GitHub, your content is stored in Magpie's infrastructure and can be accessed and exported through the Service.

Pricing & Subscriptions

Free Tier

Magpie offers a free tier with a limited number of notes per month. Free-tier limits may change with reasonable notice.

Paid Subscription

Magpie offers a paid subscription ("Magpie Unlimited") that removes note limits and unlocks additional features. Subscription pricing is displayed at the point of purchase.

Payment Methods

Subscriptions may be purchased through Stripe (web) or Apple In-App Purchase (iOS). Each payment provider's terms apply to transactions processed through their platform.

Auto-Renewal & Cancellation

Paid subscriptions renew automatically at the end of each billing period. You may cancel at any time. For Stripe subscriptions, manage billing through your account settings. For Apple subscriptions, manage billing through your device's subscription settings. Cancellation takes effect at the end of the current billing period.

Refunds

Refunds for Stripe subscriptions may be requested by contacting me through the Contact form. Refunds for Apple subscriptions are handled by Apple according to their refund policy.

Termination

Your Right to Stop Using Magpie

You may stop using the Service or delete your account at any time. The iOS app provides an account deletion option in Settings. You may also request account deletion through the Contact form.

My Right to Suspend or Terminate

I may suspend or terminate access to the Service if you violate these Terms or misuse the Service.

Effect of Termination

Upon termination, your access to the Service ends. Content stored in connected GitHub repositories remains under your control. Active Stripe subscriptions will be canceled. Active Apple subscriptions should be canceled through your device's subscription settings. Data handling after termination follows the Privacy Policy.

Additional Terms

Limitation of Liability

To the maximum extent permitted by law, Magpie is not liable for indirect, incidental, consequential, or punitive damages. Total liability is limited to the amount you paid for the Service in the twelve (12) months before the claim, or $0 if you paid nothing.

Indemnification

You agree to indemnify and hold Magpie harmless from claims, damages, or expenses arising out of: Your use of the Service. Your violation of these Terms. Your infringement of third-party rights.

Changes to These Terms

I may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
